Terms and Conditions for the supply of products.

Zoomies, hereby trading as zoomies.co.uk, in its sole discretion, reserves the right to change these terms and conditions at any time without notice, although any changes will be posted here.
Formation of the "contract":
No contract will subsist between you and Zoomies for the sale by it to you of any product unless and until you have received confirmation of your order in the form of a receipt confirming details of your order. Once the receipt has been printed out, there will be a legally binding contract between us.
This site is available only for your personal, non-commercial use.
Price:
The price that you pay is the price shown on the site in British Pounds Sterling, which includes VAT and the delivery charges, if any, set out in our Delivery Policy.
Zoomies reserves the right to change prices listed without notice. All orders for products are subject to availability and Zoomies reserves the right to decline to supply any individual or company.
Warranties:
Zoomies makes no representations or warranties regarding the accuracy, reliability or completeness of the content (text and images) of this site. To the extent permissible by law, Zoomies disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability:
Zoomies shall not be liable for loss or damages of any kind, including without limitation special or consequential damages, arising out of your access to, or inability to access, this site or your use of, or reliance upon, this site or the content hereof or for negligence (except for personal injury or death) and excludes any such liability to the fullest extent permitted by law.
The information contained in the site may contain technical inaccuracies or typographical errors and Zoomies shall not be liable for any inaccuracies or errors. In addition, Zoomies has no duty to update this site or the content hereof and Zoomies shall not be liable for any failure to update such information.

Zoomies does not control these web sites and is not responsible for their content. These links are provided merely as a service to users of the site and inclusion in this site does not constitute an endorsement by or affiliation with Zoomies. Any goods that you order from any web site to which you link from this site are subject to the terms and conditions applicable to such web site and Zoomies shall have no liability to you in respect of the same. Nothing in this agreement is intended to limit any rights you may have as a consumer under any applicable law that may not be legally excluded.
Force Majeure:
Zoomies will not be liable to you in the event that it is prevented by circumstances beyond its control from delivering any product that you have ordered or for any damaged or defective goods.
Delivery
All goods to UK destinations will be dispatched as soon as possible, usually within 5 - 10 days, Please allow up to 28 days delivery. All goods sent to world wide destinations will be dispatched as soon as possible we aim for delivery well within 28days, however we cannot guarantee the efficiency of the world wide postal system. Goods dispatched to a third party at the purchaser's request are entirely at the purchaser's own risk. Orders will be despatched by Royal Mail/Parcel Force service, which will be Parcel Force Standard. Any claims for non-delivery or shortages must be made in writing within two days of delivery. NO CLAIMS WILL BE ENTERTAINED AFTER THIS PERIOD.
Returns:
Claims will only be settled after the faulty goods have been returned with the nature of the fault clearly stated. Any goods returned incomplete i.e. packaging missing, accessories missing etc. will not be replaced or credited. Similarly any goods found to have been used will not be replaced or credited. Please note that the postage on any returned goods is the responsibility of the customer and is none refundable.
Payment
Payment is by cheque or credit card basis with order, by fax, phone, post or web site. Cheques are subject to clearance before delivery. We reserve the right to charge bank charges on cheques that are represented. We reserve the right to refuse any credit card transactions. DO NOT SEND CASH THROUGH THE POST.
Validity:
If any term, condition, or provision of these terms and conditions is determined to be unlawful, invalid, void, or for any reason unenforceable, the validity and enforceability of the remaining terms, conditions and provisions shall not in any way be affected or impaired thereby.
Entire Agreement:
These terms and conditions constitute the entire agreement between you and Zoomies relating to the subject matter herein. In particular you should note that nothing said by any Zoomies employee in relation to the site should be taken as a variation of these terms and conditions or as a representation about the products being sold by Zoomies and Zoomies shall have no liability to you or any other person for any such representation being untrue.
Governing Law:
Any contract between us will be interpreted, construed and interpreted in all respects in accordance with the laws of England and any dispute in relation to such contract shall be subject to the exclusive jurisdiction of the English Courts.

This site is owned, operated and maintained by Zoomies trading as zoomies.co.uk. This site and all perceptible components hereof, including without limitation design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software (including applets) are copyright Zoomies and its affiliates, or their content and technology providers. ALL RIGHTS RESERVED. You may only use this site and its contents in accordance with the terms and conditions of these terms and conditions.
